Step 1 — Trademark Search

Pay the government fees online: Rs. 4,500 per class for individuals, startups, and MSMEs; Rs. 9,000 per class for other entities. Upon successful filing, an acknowledgment with application number and filing date is issued immediately.

Step 4 — Trademark Examination

After filing, the Trademark Examiner reviews your application within 12–18 months. The examiner checks for conflicts with existing trademarks, compliance with Trade Marks Act provisions, and whether the mark is descriptive, generic, or deceptive. If issues are found, an Examination Report (objection) is issued. You have 1 month to file a reply or request a hearing to clarify objections. If no objections are raised, the application proceeds to the next stage.

Step 5 — Trademark Journal Publication

Once accepted, your trademark is published in the Trademark Journal for public notice. This publication remains open for 4 months for opposition. Anyone who believes your trademark conflicts with their existing rights can file a Notice of Opposition. If no opposition is filed within 4 months, your application proceeds to final registration. If opposition is filed, a legal proceeding begins, which may extend the timeline by several months.

Step 6 — Trademark Registration Certificate

If no opposition is filed, the trademark is registered and a Trademark Registration Certificate is issued with a unique registration number. This certificate is valid for 10 years from the filing date and can be renewed indefinitely. You can now use the ® symbol next to your brand name. The certificate is digitally signed and available for download on the IP India portal. Total timeline for Trademark Registration in India: 12–24 months depending on objections and opposition.


Documents Required for Trademark Registration in India

   Applicant Details Name, address, and nationality of the applicant (individual, proprietorship, partnership, LLP, company, or foreign entity).

   Logo or Wordmark Trademark representation in JPG format. For logo marks, provide clear image (3cm x 3cm to 8cm x 8cm). For word marks, specify font and style.

   Trademark Class Selected class (1–45) and description of goods or services covered under the trademark.

   Proof of Business Company incorporation certificate, LLP agreement, partnership deed, or MSME / Udyam Registration certificate (optional but recommended).

   Power of Attorney If filing through a trademark agent or attorney, submit signed POA on Rs. 100 stamp paper.

   User Affidavit Affidavit stating the date of first use of the trademark (optional but strengthens the application).

  PAN Card and Aadhaar Card — Required for individual applicants and proprietors.

   Foreign Applicants Apostilled or notarized documents, including passport and address proof if applying from outside India.


Cost and Validity of Trademark Registration in India

Government Fees

Government fees for Trademark Registration in India are Rs. 4,500 per class for individuals, startups (recognized by DPIIT), small enterprises, and MSME / Udyam Registration holders. For other entities (companies, LLPs, partnerships not under MSME), the fee is Rs. 9,000 per class. These fees are paid at the time of filing Form TM-A on the IP India portal.

Trademark Validity and Renewal

A registered trademark in India is valid for 10 years from the date of filing (not from the date of registration). It can be renewed indefinitely every 10 years by filing Form TM-R and paying renewal fees of Rs. 9,000–10,000 per class. Renewal can be done 6 months before expiry or up to 6 months after expiry with a late fee. If not renewed within this period, the trademark is removed from the register and becomes available for others to register.
